Privacy Policy

Summary:

Folsom Ready Mix, Inc. / Silver Strike Concrete, Inc. (“We” or “Us”) provides this Consumer Privacy Act Notice (“Notice”) with regards to how we collect, use, retain, and disclose personal information about California residents. The Notice also explains certain rights that California residents have under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (the “CCPA”).

During various processes of setting up customer accounts, orders and/or projects we collect certain information that would be considered “personal information” under the CCPA. Under the CCPA, this information identifies, relates to, describes, and is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular California resident or household. This information is referred to in this Notice as “Personal Data.”

Information Types:

In the above-mentioned processes, some or all of the information types listed below are gathered for purposes of conducting business and fulfilling customers’ orders:

  1. Personal Identifiers — Personal unique identifiers, such as full name and federal or state issued identification numbers including but not limited to Social Security numbers.
  2. Personal Information— Personal information, including, but not limited to, contact details (e.g., telephone number and address) and payment card details (e.g., credit and debit card numbers).
  3. Purchase Information— Purchase information, such as products and services purchased from us, information about what changes occurred to such products during delivery (i.e., water/chemical additions) and transaction histories.
  4. Internet or Online Information— Information regarding interaction with our websites, applications, or advertisements
  5. Geolocation Data— Geolocation data, such as project/order locations
  6. Audio and Visual Information— Audio, electronic, visual, thermal, olfactory, or similar information, such as call and text message recording.
  7. Inferences— Inferences based on information about an individual to create a summary about, for example, an individual’s preferences and characteristics.

Sources:

The sources from which we collect Personal Data depend on, among other things, our relationship or interaction with a specific California resident. The information below lists the categories of sources from which we collect Personal Data in different contexts.

  • From California residents directly, or other individuals acting on their behalf, through physical (e.g., paper application), audible (e.g., phone), and electronic (e.g., website, social media) sources.
  • Public records or widely available sources, including but not limited to information made available by federal, state, and local government entities (e.g., Department of Industrial Relations).
  • Outside companies or organizations that provide data to support activities such as fraud prevention, underwriting, and marketing. Examples may include 3rd party credit references, credit reporting agencies (e.g., Experian), merchant service providers, banking institutions, etc.

Why we collect personal data and how we use it:

Each of the purposes for which we collect, use, and disclose personal data is listed below with examples.  The data collected depends entirely on the specific relationship and interaction we have with each California Resident.

  1. Provide and manage products:
    1. Establish and process orders for various concrete products.
    2. Ongoing management and maintenance of concrete products for purposes of enhancing and/or improving those products to comply with certain quality, environmental and customer satisfaction aspects.
  2. Support for ongoing operational needs to manage risk, compliance and/or legal requirements:
    1. Perform accounting (i.e., invoicing, payments, etc.), monitoring and reporting.
    2. Establish accounts and related credit information.
    3. Support audits, investigations and various legal requests made of us including defending any claims against us.
    4. Fulfill legal reporting requirements as it relates to prevailing wage certified payroll reports and related documents.
  3. Manage, Improve and Develop our business:
    1. Conduct research and analysis to drive product improvement and innovation.
    2. Support customer relationship management needs
    3. Capture trends and other historical information for the purpose of improving products and delivery services to improve customer satisfaction.
  1. Support employment, infrastructure, and human resource management
    1. Identify business requirements to support business operations with ongoing changes in market dynamics.
    2. Manage pay and compensation activities.
    3. Obtain support for fulfilling the above purposes from our third-party service providers, professional services and business partners.
  2. Sensitive Personal Information as permitted by law:
    1. Process and fulfil orders, maintain and service accounts, provide customer service, verify customer information, process payments, and provide credit/financing.
    2. Activities relating to quality and safety controls.
    3. Usage for non-personalized advertising on various digital platforms

Third Party Disclosure of Personal Data:

Folsom Ready Mix, Inc. does not knowingly sell or share personal data of California Residents to third parties other than to conduct the business practices detailed above.  As to those third parties with which we share information to manage, improve and develop our business, we do not knowingly authorize those third parties to sell or share personal data of California residents to other third parties.

Retention and Protection of Personal Data:

We collect, store and maintain personal data for as long as necessary to perform the above-mentioned business practices set forth in this Notice but no longer than as required or permitted under applicable law or internal document retention policies.  Personal data is disposed of in accordance with document retention policies. We are committed to protecting all Personal Data we collect and use. To that end, we have implemented physical, administrative, and technical safeguards to help us protect Personal Data under our control from unauthorized access, use and disclosure.

However, no system of electronic data collection, storage and retrieval can be made entirely impenetrable and by continuing to use our Sites and Products you acknowledge and accept that despite the security measures we employ, we do not guarantee that our Sites, Products, and procedures are invulnerable to all security breaches or immune from viruses, security threats or other risks.

Resident Requests and Responding Protocols:

If you are a California resident, you can make certain requests regarding your personal information, and we will fulfill each request to the extent required by law. As stated in more detail below, you can request that we:

  1. Provide you with access to a copy of and certain details regarding the personal information we have about you.
  2. Delete your personal information.
  3. Correct your inaccurate personal information.
  4. Limit the use or disclosure of your sensitive personal information (SPI).
